GENERAL TERMS AND CONDITIONS

1. Scope of validity
These General Terms and Conditions (GTC) apply to all business relationships between the company CONSTRUCCIÓN Y REFORMAS THOMAS MELZER (hereinafter referred to as ‘Provider’) and its customers in the version valid at the time the contract is concluded.

3. Description of services
CONSTRUCCIÓN Y REFORMAS THOMAS MELZER offers various craft services, which are described in detail on the provider’s website. The exact service and scope of services are defined in an individual contract between the provider and the customer.

4. Conclusion of contract
(1) The presentation of the services on the website does not constitute a legally binding offer, but an invitation to the customer to submit an offer.

(2) The customer submits a non-binding offer to conclude a contract by submitting an enquiry via the contact form provided, by email or by telephone call.

(3) The provider shall contact the customer to clarify the details of the potential order. The offer is accepted by both parties by means of an order confirmation sent to the customer by e-mail.

5. Prices and terms of payment 
(1) Payment shall be made by bank transfer. Cash payments are accepted within the scope of the statutory provisions.

(2) The invoice amount is due pro rata, depending on the agreement. An initial down payment is due in any case. After payment of the first down payment, the work will commence.

Unless otherwise agreed, payment for completed parts of the work must be made within 5 days of completion.

6. Service period
(1) The performance deadlines and dates are based on the individual agreements with the customer.

(2) Delays caused by force majeure or other circumstances for which the provider is not responsible shall extend the performance deadlines accordingly.

7. Liability and warranty
(1) The provider shall only be liable for damages that are attributable to wilful or grossly negligent breaches of duty by the provider or its vicarious agents.

(2) In the event of a slightly negligent breach of material contractual obligations, liability shall be limited to the foreseeable damage typical of the contract.

(3) The warranty shall be governed by the statutory provisions.

8. Right of cancellation
The customer has a fourteen-day right of cancellation on condition that manual services have not yet been provided.

9. Data privacy
(1) The provider collects, processes and uses the customer’s personal data only within the framework of the statutory provisions.

(2) Further information on data protection can be found in the privacy policy on the provider’s website.

10. Final provisions
(1) The law of the Kingdom of Spain shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

(2) The place of jurisdiction for all disputes arising from contractual relationships between the provider and the customer is the registered office of the provider, provided that the customer is a merchant, a legal entity under public law or a special fund under public law.

Should any provision of these GTC be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.
